As recently as 2010, the WI Supreme Court confirmed that licensed WI real estate agents may continue to exercise the limited right to practice law. This practice of law is done through the use of approved real estate forms, and that is where it ends, but the forms are not something you can “DIY.” These forms create legally binding contracts, and, if used incorrectly, may lead to serious legal and financial consequences. Keep in mind, these forms are often revised. Agents are required to complete continuing education every two years, maintain accountability to various levels of authority, from their managing broker to ethics boards and the Department of Safety and Professional Services (DSPS), and typically hold extra liability insurance.
When hiring a listing agent, you need to see through the sales pitch and decide if the agent is the one you trust most to take you through this process. Do they spend most of their time justifying their hefty commission, or talking strategy about how to maximize your equity?
